Terms of Service

1. Acceptance of These Terms

By downloading, installing or using MyQuotaBag, you agree to these Terms of Service. Our Privacy Policy explains how we handle your information. If you do not agree to these Terms, do not use the app.

2. What MyQuotaBag Is

MyQuotaBag is a personal record-keeping app for Hermès collectors. With it you can:

  • record your purchases and see your Purchase Ratio
  • keep a Journal of boutique visits, notes and private events
  • keep a Gallery of your pieces, your dream items and your Quota Bag
  • fill in purchases by scanning a receipt, which is read by AI, or add them by hand
  • read an optional Daily Reflection written by AI
  • use the app as a guest, or sign in with Apple or Google to keep your data in an account

The app is currently free to download and use. Some features may become part of a paid plan in the future. We will update these Terms and tell you in the app before any feature becomes paid. It is provided for your personal information and organization only.

The website's editorial content, including the Quota Bag Brief, the Insider Guide, the Ratio Calculator and MyQuotaBag Data, is also for information only. It is not purchasing, financial or legal advice. Your purchasing decisions are your own.

3. No Affiliation

MyQuotaBag is an independent app. It is not affiliated with, endorsed by, sponsored by or approved by Hermès International or any of its affiliates. Hermès names, products, boutiques and categories are mentioned for descriptive purposes only and "Hermès" and related trademarks belong to their owners.

4. No Promise of Access to Any Bag

MyQuotaBag does not promise, predict or influence any offer, allocation, wait time or boutique decision, or your relationship with any brand or store. Using the app does not give you access to any product.

Your Purchase Ratio and every figure, category or text in the app is an observation based on what you entered. It may be incomplete or wrong, it does not reflect any brand policy and it is not a target or a spending recommendation. How you use it is your decision.

5. Scan, Photo and Imports

Scan and Photo send the receipt image you choose to an external AI service provider, which reads it and returns the purchase details. Import from screenshots does the same with the screenshots you choose. You review the result before anything is saved. How these images are handled is described in the Privacy Policy.

By using these features, you agree that:

  • you will only submit receipts and images that you have the right to use
  • you will hide or crop personal details you do not want read or stored, such as your name, address, customer number or payment details
  • AI can misread an image, miss an item or choose the wrong category and it is your responsibility to check every detail before saving
  • MyQuotaBag is not responsible for reading errors caused by image quality, lighting, layout or an unsupported receipt

The number of scans may be limited, for example for guests. Limits may change.

Import history (in Profile) asks you to use an AI assistant of your choice. Your use of that assistant is governed by its own terms.

6. Daily Reflection

The Daily Reflection is an optional short text written each day by an AI, from your journey in the app and the mood you choose. It is offered for enjoyment and reflection. By using it, you agree that:

  • the text is written automatically by an AI, which can be wrong, invent details or misread your own data
  • MyQuotaBag does not review each reflection and you should check anything that matters to you before relying on it
  • a reflection is not a prediction, not advice and not a recommendation to buy and it says nothing on behalf of any brand, boutique or Sales Associate
  • the number of reflections and replies per day is limited and limits may change

7. Guest and Account

As a guest, your data is stored on your phone only. It can be lost if you delete the app, reset or lose your phone. With an account, your data is kept in your account and can be found again on another device. You are responsible for keeping your device and your Apple or Google sign-in secure.

8. Deleting Your Account

You can delete your account at any time in Profile. Deletion removes your account and your data from our servers, including your purchases, Quota Bag, visits, notes, photos and receipts. It cannot be undone. Receipt images saved on your phone stay there until you delete the app. Export your data first if you want to keep a copy.

9. Eligibility

You must be at least 18 years old to use MyQuotaBag. By using the app, you confirm that you are.

10. Your Content

What you enter and upload remains yours. You give MyQuotaBag only the permission needed to store it, process it and show it back to you in order to run the app. You are responsible for the accuracy of what you enter and for having the right to upload it.

11. Acceptable Use

You agree not to:

  • use the app for any unlawful purpose
  • upload content you do not have the right to use
  • interfere with, disrupt or try to gain unauthorized access to the app or its infrastructure
  • reverse engineer or decompile the app, except where the law allows it
  • scrape or extract app content or data by automated means
  • impersonate another person

12. Intellectual Property

The MyQuotaBag app, name, design, software and original content belong to MyQuotaBag or its licensors and are protected by intellectual property laws. The aggregated figures published in MyQuotaBag Data are licensed under CC BY 4.0, as stated on those pages; nothing else on the site is.

13. Third-Party Services

The app relies on third-party services for hosting and storage, sign-in (Apple and Google), anonymous usage statistics and AI reading and writing. We are not responsible for outages or failures of those services.

14. Changes to the App

We may change, limit, suspend or discontinue any part of the app at any time. Features may be added, changed or removed.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND AVAILABILITY.

We do not warrant that the app will always be available or error-free, that calculations, AI readings or reflections will be accurate, or that your data will never be lost. Keep your own copy of anything important to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYQUOTABAG AND ITS SERVICE PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING DAMAGES RELATED TO PURCHASING DECISIONS, MISSED OPPORTUNITIES, LOST DATA, SERVICE INTERRUPTIONS, INCORRECT CALCULATIONS, AI READING ERRORS OR RELIANCE ON ANY TEXT OR FIGURE IN THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US TO USE THE APP IN THE 12 MONTHS BEFORE THE CLAIM AND THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW.

Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

17. Indemnification

You agree to indemnify MyQuotaBag and its service providers against claims arising from your misuse of the app, the content you upload or your violation of these Terms or of another person's rights, to the extent permitted by law.

18. Suspension and Termination

We may suspend or end your access if you violate these Terms, if we reasonably suspect misuse or unlawful conduct, or if running the service becomes impossible. You may stop using the app at any time and delete your account in Profile.

19. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there, without regard to conflict of law rules, except where the mandatory consumer law of your place of residence requires otherwise.

20. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are the entire agreement between you and MyQuotaBag about the app.

21. Changes to These Terms

We may update these Terms. We will update the "Last Updated" date above and, for a significant change, give you notice before it applies, in the app or on this website. If you do not agree, you can stop using the app and delete your account.
